Reality has come crashing down on the TV and film industry over the last few years. Sexual abuse in this industry has been one big open secret for decades, but now survivors are standing up for themselves with the assistance of advocates and film and TV industry sexual abuse attorneys in California.
Sexual abusers in the film and TV industry usually have the ability and time to groom people into trusting them. Perpetrators of this abuse can include anyone in a position of power, from well-known actors and producers to lesser-known executives and behind-the-scenes workers.
Pursuing Justice Through a Sexual Abuse Lawsuit in California
The film and TV industry is full of high-powered professionals, many of whom are individuals who value money and reputation above all. Those who abused others were able to keep their sexual abuse a secret while continuing to profit off their victims who work within the industry. Your voice may have been silenced by those well-connected in Hollywood, but a lawsuit allows you to be heard.
Through taking civil action, you can find vindication in exposing the truth and telling your story. A civil suit allows you to have a say in the details of your life that you share and in deciding the outcome of your case. Whether you choose to sue the liable party, agree to a settlement, or move the case to trial is within your control as the person bringing the sexual abuse claims to light.
Though no verdict of guilt is given in a civil case for sexual abuse, a successful resolution could bring you validation, closure, and healing. Receiving compensation for your suffering is acknowledgement of the trauma that the sexual abuse left you with. It is an affirmation that you were wronged and someone else is responsible.
Our California Film and TV Industry Sexual Abuse Lawyer Can Help You Recover Damages
Though financial compensation can’t erase your painful experiences, it can help in many ways. The money you may receive in your California TV and film industry sexual abuse claim can cover economic and non-economic damages.
You may be able to recover monetary damages, such as:
- Lost wages from time off work
- Medical expenses
- Mental health counseling costs
- Travel expenses
- Other financial losses
Though you may suffer physical injuries, the most severe injuries sexual abuse survivors experience are often emotional and psychological. Sexual abuse is a traumatic event that can reverberate throughout many areas of your life, leaving you feeling despondent, anxious, fearful, and alienated. While these injuries are not external, they are very real. You may be able to recover compensation for non-economic damages, such as:
- Sexually transmitted diseases
- Unwanted pregnancy
- Scars and disfigurement
- Post-traumatic stress disorder (PTSD)
- Anxiety
- Depression
- Fear
- Social isolation
- Shame or humiliation
- Damaged reputation
- Reduced quality of life
- Reduced enjoyment of activities
- Other emotional distress
Our California sexual abuse lawyers serving the TV and film industry can help you further understand the injuries you may receive compensation for. Our legal team will fully analyze the damages you’ve suffered financially, physically, emotionally, and psychologically to calculate an accurate compensation amount.
Statute of Limitations for Sexual Abuse Cases in California
In 2018, Governor Gavin Newsome signed off on Assembly Bill 1619, extending the time adult sexual abuse victims are given to file a civil case in court. Under the new law, Ca. Civ. Proc. Code § 340.16, adult survivors of sexual abuse in TV and film have ten years from the date of the last sexual act or three years from the date they discover an illness or injury that resulted, to file a lawsuit against the perpetrator or another liable party.
In 2019, California passed Assembly Bill 218, extending the statute of limitations for child sexual abuse cases in California. Victims of child sexual abuse now have until the age of 40 to file a legal action or within five years of discovering the abuse as an adult, per Ca. Civ. Proc. Code § 340.1
There is also a retroactive window for a limited time that allows child sexual abuse survivors to file a suit within three years of the date AB 218 went into effect if they missed the statute of limitations in their case.
