What Is Covered Under Assembly Bill No. 2777?
Assembly Bill No. 2777, or, as it is also called, the Sexual Abuse and Cover-Up Accountability Act, was enacted on January 1, 2023.
The Act amends Section 340.16 of the Code of Civil Procedure in this way:
- Survivors of adult sexual abuse have until December 31, 2023 to file a lawsuit regardless of when the abuse occurred, if their case meets the following criteria:
- The abuse occurred on or after your 18th birthday;
- An entity or institution shares responsibility for the abuse that occurred; and
- The entity or institution attempted to cover up the abuse or prevent information about abuse from surfacing.
- Adult survivors have until December 31, 2026 to file a lawsuit, if their case satisfies the following criteria:
- They were 18 years of age or older when the abuse occurred;
- The abuse occurred on or after January 1, 2009; and
- They were previously unable to file a lawsuit because of an expired statute of limitations.
- The Assembly Bill does not apply to claims that reached a final judgment or settlement prior to January 1, 2023.
